SÜLEYMAN ÖZER PERSONAL DATA PROTECTION AND PROCESSING INFORMATION TEXT
This document is prepared to inform you, our valued patients, about the collection, storage, processing, and transfer of your personal data provided to us during the healthcare service process by Dr. Süleyman ÖZER and his staff. This information is provided by Dr. Süleyman ÖZER as the data controller in accordance with the provisions of the Law No. 6698 on the Protection of Personal Data ( “ KVKK”) and other relevant legislation.
As Dr. Süleyman ÖZER Clinic, the health data we need to record in order to provide you with healthcare services is considered special category data under the law. In this context, pursuant to Article 6, paragraph 2 of the Law No. 6698 on the Protection of Personal Data, which states that “Processing special category personal data without the explicit consent of the data subject is prohibited,” personal health data can only be recorded with the explicit written consent of the individual, except under the specific conditions stated in the law. Therefore, we are obliged to obtain your consent. Within the scope of the legislation, we will record, archive, update, transfer, classify, and process your personal data and “special category” personal data specific to healthcare services in the manner described in this disclosure text and in the ways stipulated in the Law on the Protection of Personal Data and related legislation.
Your personal data is processed in accordance with the Personal Data Protection Law (KVKK) for the purpose of establishing and fulfilling a healthcare contract with you, fulfilling our legal obligations, ensuring that fundamental rights and freedoms are not harmed, when data processing is necessary for our legitimate interests, for preventive medicine, conducting medical diagnostic services, providing, financing and managing healthcare services, improving service quality, ensuring workplace safety, in accordance with relevant legal regulations and measures taken by the Personal Data Protection Board.
1- Your Personal Data That We May Process With Your Explicit Consent and the Purposes of Processing Them
Your Identity Information: Your name, surname, Turkish Republic identity number if you are a Turkish citizen, passport number or temporary Turkish Republic identity number if you are a foreigner, place and date of birth, photograph, marital status, gender, blood type, insurance or patient protocol number, and other identification data that we can use to identify you.
Your Contact Information: Your address, phone number, email address, and other contact details.
Location Information: Your location based on your address.
Your Accounting Information: Your financial data such as your bank account number, IBAN number, credit card information, and billing information; your private health insurance data and Social Security Institution data for the purpose of financing and planning healthcare services,
Your Health Information : Your examination data, medical history data, medical family history data, genetic data, laboratory results, medical imaging results, test results, examination appointment information, prescription information. All communication and correspondence with your doctor digitally (email, SMS, social media, digital messaging platforms, etc.) during the pre-examination consultation, diagnosis, treatment, and follow-up process. All information and data you provided in the information texts and consent forms presented to you before the procedure. Your health data recorded in other healthcare institutions and deemed medically necessary to be included in your file at our clinic (consultation notes, surgery notes, test results) is also included in this scope. Your personal data relating to social, family, and sexual life obtained during or as a result of the provision of medical diagnosis, treatment, and care services is also included in this scope.
Physical Security: Our clinic is equipped with security cameras that record video to fulfill our obligations regarding the legal and commercial security of individuals.
Your personal data obtained by Dr. Süleyman ÖZER will primarily be used to provide you with effective, safe, and high-quality healthcare services. General purposes of using your personal data include verifying your identity, facilitating doctor-patient communication, protecting public health, preventive medicine, planning and effectively executing medical diagnosis, treatment, and care services, planning and managing healthcare financing, planning and managing the internal workings and daily operations of our clinic, and procuring medications and supplies. If you make an appointment at our clinic, we will use your contact information to inform you about your appointment.
Your personal data may be used for purposes such as in-clinic risk management, carrying out quality improvement activities, training and development of our employees, ensuring patient and employee safety, monitoring unauthorized internal transactions, measuring patient satisfaction, improving healthcare services, and fulfilling legal and regulatory requirements.
Your personal data may be processed to confirm your relationship with our partner institutions, to bill for our healthcare services, and to share requested information with private insurance companies regarding the financing of healthcare services.
In accordance with relevant legislation, your personal data may be used to share requested information with the Ministry of Finance, the Ministry of Health, and relevant public institutions and organizations; to provide necessary information in line with the requests and audits of regulatory and supervisory bodies and official authorities; to maintain your health data that must be kept in accordance with relevant legislation; and to respond to all your questions and complaints regarding our health services. Your special categories of personal data may be used, with your explicit consent, for the education and information of other patients and the public, and for scientific research and training purposes.
2- Cases Where Explicit Consent is Not Required for Personal Data Processing According to the KVKK (Law on Protection of Personal Data)
If at least one of the following conditions applies, your personal data may be processed even without your explicit consent .
- If it is explicitly provided for in the laws,
- It is necessary for the protection of the life or physical integrity of a person who is unable to express their consent due to factual impossibility or whose consent is not legally valid.
- This is necessary for Dr. Süleyman ÖZER Clinic to fulfill its legal obligations.
- The fact that it was made public by the person concerned,
- Data processing must be necessary for the establishment, exercise, or protection of a right.
- Data processing is necessary for the legitimate interests of Dr. Süleyman ÖZER Clinic, provided that it does not harm the fundamental rights and freedoms of the data subject .
Your personal data relating to health and sexual life may be processed by Dr. Süleyman ÖZER without your explicit consent only for the purposes of protecting public health, preventive medicine, conducting medical diagnosis, treatment and care services for you, and planning and managing the health services you receive and their financing.
3- Transfer of Your Personal Data Within the Country
Personal data generated and collected during healthcare services provided by Dr. Süleyman ÖZER may be transferred to other healthcare providers for consultation purposes.
Your personal data related to our services may be transferred to private insurance companies, the Ministry of Health and its sub-units, the Social Security Institution, the General Directorate of Security and other law enforcement agencies, the General Directorate of Population, the Turkish Pharmacists Association, the Courts of the Republic of Turkey and all kinds of judicial authorities, central and other third parties, your authorized representatives, lawyers, tax and financial consultants and auditors, including third parties from whom we receive consultancy services, regulatory and supervisory institutions, official authorities, and our business partners with whom we cooperate to develop or carry out health services for the purposes stated above, as well as to third parties within the country within the framework of the personal data transfer conditions and purposes specified in Articles 8 and 9 of the Law.
4- Methods and Legal Grounds for the Collection and Processing of Your Personal Data
The personal data that is the subject of this information text is obtained by Dr. Süleyman ÖZER and his staff during the provision of healthcare services. Data collection may take place during face-to-face meetings, as well as through telephone, website, email, digital messaging platforms and social media channels. Your personal data may be obtained and processed through various means, including: completing patient information forms and consent forms; written, verbal or email notifications from you; recordings of telephone calls; information you enter on our website; notifications from your private health insurance company; results of your medical examinations; notifications from hospitals where you received treatment or underwent examinations, etc., in any verbal, written, visual or electronic medium.
Your personal data may be processed for the purposes of providing medical treatment and services, informing you about our services, notifying you of your appointment if you have one, enabling you to benefit from products and opportunities related to our business activities, keeping you informed about events, services and developments, conducting analysis to improve services, ensuring workplace security, performing backups to prevent data loss, billing, sending SMS and commercial electronic messages, informing you and our followers on our social media accounts, measuring patient satisfaction and answering all your questions and complaints within the scope of our health services, ensuring digital and physical data security, and fulfilling legal obligations as required or mandated by legal regulations, as well as for other purposes specified in the KVKK (Personal Data Protection Law).
Maintaining regular patient records and making them available to patients and legal authorities when necessary is a legal requirement in the provision of healthcare services. Similarly, maintaining regular financial records is mandatory for individuals and institutions in terms of their tax obligations.
You can find the legal grounds for the collection and processing of your personal data by reviewing the following laws: Law No. 6698 on the Protection of Personal Data, Law No. 3359 on the Basic Law of Health Services, Decree Law No. 663 on the Organization and Duties of the Ministry of Health and its Affiliated Institutions, and the Regulations on Private Health Institutions.
5- Preservation of Your Personal Data
Your personal data is processed by Dr. Süleyman ÖZER Clinic for a period necessary for its processing, as required by the principle of purpose limitation. After this period, the data is deleted, destroyed, or anonymized. This period may vary from patient to patient and from data to data. Some of your personal data is stored in writing in our clinic files, protocol books, and financial records. Your contact information is stored in the internal and SIM card memory of our clinic’s mobile phone. Your electronic and digital data is stored on clinic computers and backup hard drives. Your personal data is kept locked at our clinic.
Patient and employee data at Süleyman ÖZER Clinic is confidential. No one may use, copy, reproduce, transfer to others, or use this data for purposes other than business purposes without compliance with the contract or law. Only authorized persons may access personal data within the clinic. All necessary technical and administrative measures are taken to prevent unauthorized access to collected data, to protect it, and to prevent the data subject from being harmed.
6- Rights of the Data Subject as the Data Subject
As the owner of the personal data collected, processed, and transferred by Dr. Süleyman ÖZER, you, our valued patients, may exercise your rights mentioned under this heading and/or within the scope of the Personal Data Protection Law (KVKK) in accordance with the procedures and principles stipulated in this Disclosure Statement and the legislation, or if you apply to Dr. Süleyman ÖZER Clinic ; your requests included in your application will be processed free of charge within a maximum of 30 (thirty) business days, depending on the nature of the request. However, if the process requires additional costs for Dr. Süleyman ÖZER, a fee may be requested according to the tariff determined by the Personal Data Protection Board.
According to Article 11 of the KVKK (Law on Protection of Personal Data), data subjects (data owners – service users);
Individuals have the right to: (i) learn whether their personal data is being processed; (ii) request information regarding the processing of their personal data if it has been processed; (iii) learn the purpose of the processing of their personal data and whether it is being used in accordance with its purpose; (iv) know the third parties to whom their personal data has been transferred, domestically or abroad; (v) request the correction of their personal data if it is incomplete or inaccurate, and request that these changes be notified to the third parties to whom the personal data has been transferred; (vi) request the deletion or destruction of their personal data if the reasons requiring its processing have ceased to exist, even if it has been collected, processed, and transferred in accordance with the law and relevant regulations, and request that this action be notified to the third parties to whom the personal data has been transferred; (vii) object to a result that is detrimental to them arising from the analysis of processed data exclusively through automated systems; and (viii) demand compensation for damages if they suffer harm due to the unlawful processing of their personal data.

It is mandatory to provide this information and any relevant documents and information, if available, to be attached to the application.
Requests regarding the exercise of these rights may be submitted to us by personal data owners through the methods specified in Law No. 6698.
The information contained in this form may be subject to change in accordance with legal and technological developments.
7- Periods During Which Personal Data Will Be Processed
In accordance with Article 7/2 of the Law No. 6698 on the Protection of Personal Data, processed personal data shall be deleted, destroyed, or anonymized by the data controller, either automatically or upon the request of the data subjects, when the reasons requiring their processing cease to exist .
8- Data Security
“Dr. Süleyman ÖZER”, as the data controller under the KVKK (Turkish Personal Data Protection Law), takes all necessary physical, digital, technical and administrative measures to ensure an appropriate level of security in order to prevent the unlawful processing of personal data, to prevent unlawful access to personal data, and to ensure the preservation of personal data.
